that someone said they where only 17 in chat

we here at milovana strictly enforce a no underage rule
you can not even joke about it.
we take all such reports seriously.

I was unable to ban the person, because they were in the lounge.

You must report any such communication immediately to any moderators

however if there are none in the chat room
the proper thing to do is send Seraph0x a report.

do NOT talk to anyone under age, do not post pics to them,
and ask them to leave ASAP.

Keeping kids away from adult material is important, but this particular case sounds like massive exaggeration to me. I think the 17 deal is to comply with law reasons, we would not want Milovana to be shut down would we?

BTW, is it legally required to only allow access to 18+ year olds? Otherwise I guess it could be construed as distributing pornography to minors?

I don't think, it's for law reasons, as we don't enforce that rule and it would be hard to do so (especially in an international setting).
I'm pretty sure this site would be border-line illegal under German law as it has some hard core pornography in it. So the only reasonable thing is, to not care about laws and find a suitable jurisdiction.

The rule is respected here for moral reasons, I guess. I don't think, there is anything wrong with teenagers using this site or chatting about sex, so I think there is a bit too much fuzz made about it. I wouldn't feel very comfortable engaging in whatever kind of sexual activity with someone under age, not even online, but if some horny teenager finds it's way into the chat, who cares. The activity there is consensual and usually not especially "hard-core".

That is another matter entirely.

Even if the site answers to US law (or other laws equally ridiculous and conservative when it comes to sexual topics), that still does not mean each user is responsible for playing cop.

There is no way in hell that the site, seraph or anyone else could get in legal trouble from a regular user failing to report observed underage users on this site. Period.

I respect that seraph may be obligated or otherwise choose to submit to any legislation he darn well pleases, but again, that is a completely separate matter than what SC is talking about when it comes to the expectation of users reporting underage users.

Reporting underage porn is yet another, completely different matter. Still doubtful that any user failing to report it could get themselves or the site into any sort of trouble, but the motivation is obviously entirely different in that scenario.

Don't get me wrong - I don't fancy mixing up kids and sex/porn. But I also don't fancy or agree with the values of countries trying to think of anyone below 18 as kids in sexual matters.

In my own country, there is no age limit for when people of similar age may have sex with each other. In theory, two 7 year olds could have legal sex with each other if it happened with mutual consent. The legal limit for sex where the age difference is significant though, is 16. Which works fine with me, but 18 is definitely too high.

Are you saying hardcore porn is flat out banned in Germany? That I find hard to believe.

Are you sure you are not confusing rules for TV broadcasts etc (which in many countries are way more restrictive) with a general ban?

I my own country, TV broadcasts may not show "genitals in motion". That in no way means it is illegal to produce and sell hardcore porn through other channels than TV.

Not saying I don't believe you, but as a hobby student of law I would be very interested in a reference to the German laws on this subject.

No, of course not. There is just a law with the (obviously useless) requirement, that hard-core-porn-websites need an effective age verification system. So most porn websites hosted in Germany use some age verification service you have to sign up for by name and mail and pay a small fee.
Of course this law is pretty useless as everyone can use other websites as soon as he speaks English well enough to look at pictures. Germany just has quite outdated and surprisingly restrictive "youth protection" laws.
Anyway, I just used Germany as an Example.

Is anyone disputing that? The rules for this site are quite clear on the matter, nor do I have any problem with that at all.

I just won't accept any part of responsibility of enforcing them - if users break the rules of the site that is quite simply none of my business unless I choose to make it such.

janmb is right in these matters I would agree. I know about the laws but lets face it. The 17 eyar old is much better off chatting about these thigns isntead of waiting for a extra year. I remember looking at these type of sites when I was 15. It is when the user is ready some people are too scared until they are much older. it depends how fast the person matures.

I remember, a few years back, this 15 year old kid on an (unrelated) forum who pm'd me on ways to find porn when I mentioned in a thread something about not being able to find a certain porn niche

He knew all about specific porn torrent sites, and torrenting; much much more than I did. And I ama relatively tech savvy person


The reality of the situation is that there are a number of under 18'ers using this site. Pretty much guarenteed.

It is his site fully funded by his own monies and/or efforts.

I suggest that people respect that and if they are under age do not publicise that fact.
I have politely told others to amend age references, or take down a posting if that is not possible.

Like most things we all know of situations that are outside of recommendations,
It is the blatant rule bending that causes problems.

I include cinema films and Computer/Video games in this.
